Policy
PREVENTION OF NEEDLESS PUBLIC LABELING OF EDUCATIONALLY
HANDICAPPED PUPILS
The Kearny Board of Education hereby adopts the policy that no educationally handicapped pupil shall be needlessly publicly labeled, including the following:
n Personally identifiable data shall be kept confidential.
n Personally identifiable data shall not be included in public acts and records, except upon the written request of the parent or adult pupil.
n All pupil records shall be maintained according to N.J.A.C. 6:3-2.
n The avoidance of pupil labeling shall include, but is not limited to:
Ø Public address announcements
Ø Classroom signs
Ø Open circulation of documents designating an individual pupil or class as handicapped
Ø Open circulation of photographs and audio or videotapes
The procedures used to implement the above policies shall include, but not be limited to, the following:
No educationally handicapped pupil’s name shall be used at a public meeting, including board of education meetings and that care shall be taken to provide confidentiality and to protect the identification of educationally handicapped pupils in written, oral, and visual modes of communication, and that educationally handicapped pupils shall, when necessary, be referred to by assigned identification numbers.
Release of information regarding individual pupils or classes to outside agencies, (i.e., newspapers) shall require the written permission of the parent(s) or adult pupil.
The board of education shall provide for the prevention of needless public labeling when determining eligibility and classification of pupils for special education and/or related services according to N.J.A.C. 6A:14.
This Resolution supersedes any previous Resolution.
