Policy  

                 COMPILATION, MAINTENANCE, ACCESS TO AND CONFIDENTIALITY

                                   OF PUPIL RECORDS ACCORDING TO N.J.A.C. 6:3-2

 

The Kearny Board of Education adopts the following policies for pupil records:  

1.             Guarantee access to persons authorized under this sub-chapter within 10 days of the request, but prior to

any review or hearing conducted in accordance with State Board of Education regulations.  

2.             Assure security of the records.  

3.             Enumerate and describe the pupil records collected and maintained by the Kearny Board of Education.  

4.             Provide for the inclusion of educationally relevant information in the pupil record by the parent or adult pupil.  

5.             Allow for the designation, release and public notice of directory information as defined herein.  

6.             Accord educational, occupational and military recruiters access to school facilities and student information directories pursuant to N.J.S.A. 18A:36-19.1, provided that any adult pupil or parent may request in  writing to the chief school administrator to be excused from participating in all recruitment purposes.  

Provide the parent or adult pupil with a 10-day period to submit a written statement to the chief school administrator prohibiting the institution from including any or all types of information about the student in any student information directory before allowing access to such directory and school facilities to educational, occupational and military recruiters pursuant to N.J.S.A. 18A:36-19.1.  

7.             Assure limited access to pupil records by secretarial and clerical personnel pursuant to N.J.A.C. 6:3-2.5.  

8.             Provide for access and security of pupil records maintained in a computerized system.  

9.             Provides for the notification of the parent or adult pupil when releasing mandated educational information to public schools where the pupil is enrolled or intends to enroll.  (Authority: 34 C.F.R. 300.571 (B), (C), Part 99.34, N.J.A.C. 6:14-2.7(c).  

10.          Assures that the district has policies and procedures to institute due process hearing procedures, if consent to release the pupil record information is refused by the parent(s).  

11.          Assures that all persons collecting or using personally identifiable information receive training regarding the confidentiality of personally identifiable information.  

12.          Ensures the maintenance of a current list of names and positions of those employees within the district who may have access to personally identifiable information.  

13.          Informs the parents when personally identifiable information collected, maintained or used is no longer needed to provide educational services to the child.  

14.          Requires the destruction of information when no longer needed to provide educational services at the request of the parent, except for the student’s name, date of birth, sex, address, telephone number, grades, attendance record, classes attended, grade level completed, year completed, name of parent(s) and citizenship status.  N.J.A.C. 6:3-6.8(e).
